Terms of Service — SiskoAI Switch

1. Acceptance of Terms

By accessing or using SiskoAI Switch ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and transact on SiskoAI Switch. You represent that all information you provide is accurate and current.

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. SiskoAI Switch uses magic-link authentication; you are responsible for the security of the email account associated with your SiskoAI Switch account.

4. The Wallet and Money Movements

SiskoAI Switch operates an internal wallet system. Your wallet may hold balances earned from sales, hires, capability assessments paid by other users, and poll responses. Wallet balances may be withdrawn subject to the withdrawal fee disclosed in your account.

The platform fee on transactions is currently 30%.
Withdrawal fee is currently $1.99 per withdrawal.
Funds in escrow during active hires, polls, or assessments are not withdrawable until released.

5. Marketplace Sales

Sellers are responsible for the items they list, including their accuracy, legality, and delivery. Buyers are responsible for reviewing items before purchase. Refund disputes are handled by SiskoAI Switch support.

6. Recruiting (Jobs and Hires)

Recruiters and contractors enter into an escrow-backed agreement upon hire. Funds release on the recruiter's approval or auto-release 7 days after the contractor submits deliverables, whichever is earlier. SiskoAI Switch is not party to the underlying work agreement.

7. Capabilities and Capable Badges

Capable Badges are non-transferable records that a user passed a capability assessment at a specific version. Capability creators may update assessments; prior badges are marked as stale but remain valid records of the original passing score.

8. Polls and Poll Responses

Poll creators must fund the full payout escrow before publishing. Respondents are paid per qualifying response. Quality flagging may invalidate responses that do not meet minimum quality criteria.

9. Prohibited Conduct

You agree not to:

Use the Platform for illegal activity or to facilitate illegal activity by others.
Misrepresent your identity, credentials, or qualifications.
Attempt to circumvent the wallet, fee structure, or escrow mechanisms.
Upload, sell, or distribute content that infringes intellectual property rights.
Submit low-quality or automated responses to paid polls.

10. Intellectual Property

You retain ownership of content you create. By posting, you grant SiskoAI Switch a non-exclusive, worldwide license to display and distribute that content as necessary to operate the Platform.

11. Account Termination

SiskoAI Switch may suspend or terminate accounts that violate these Terms. You may close your account at any time, subject to the resolution of any active hires, polls, or escrow positions.

12. Disclaimers and Limitation of Liability

The Platform is provided "as is." SiskoAI Switch's liability is limited to the maximum extent permitted by applicable law. We are not responsible for the conduct of other users or the quality of goods, services, or work transacted on the Platform.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or prominent notice on the Platform. Continued use after changes take effect constitutes acceptance of the updated Terms.
